6. Obligations when Buying Products from Outside of Quebec Intended for Resale

6.1 Any individual or firm (hereafter named the Merchant) buying from a supplier located from outside of Quebec, any agricultural produce and foodstuff bearing a reserved designation and intended for sale on Quebec territory, must register with the CARTV through making an "annual declaration." In order to do so, they must submit a request to the CARTV who will in turn provide them with an official form intended for this purpose. As indicated by the form's headings, the CARTV will require that the Merchant to provide the following information:

name (Merchant's company name)
address of principal place of business
names and addresses of organizations that have certified products acquired from suppliers outside of Quebec
category of products bought from suppliers outside of Quebec (foodstuff or perishables)

6.2 Once submitted, this application constitutes an agreement that the Merchant will sell, for any reserved designation, only those products certified by an accredited organization or one that the CARTV has recognized as compliant. A registration certificate will then be issued by the CARTV.

6.3 The above requirements do not apply to persons or firms carrying out processing operations in Quebec and that buy agricultural products and foodstuff coming from outside of Quebec for use as ingredients in a foodstuff certified by an organization accredited by the CARTV.

6.4 As with all processing and subsequent packaging operations (leading to labels’ modifications) carried out in Quebec, they must have undergone control by an accredited certifier, where the latter was responsible for approving products purchased – regardless of their source – and used as ingredients in the manufactured foodstuff certified.

6.5 Merchants who sell organic agricultural products and foodstuff originating from outside of Quebec should make sure that these products were certified by an organization that the CARTV has accredited or has recognized as being compliant.

6.6 CARTV shall make public the name of registered merchants relative to products bearing a reserved desigantion.
