6. Revocation of Approval
6.1 The approval granted to a certifying body may be revoked by the Board if one of the clauses in the application for recognition is no longer respected due to any noncompliance noted regarding the Québec Product Entry Acceptance Program, or regarding product labeling requirements
6.2 Before a certifying body’s approval may be formally revoked, it shall have received a notice from the CARTV informing it of each noncompliance detected, along with a request that it be resolved to the satisfaction of the CARTV within 60 days and advising it that failure to apply corrective measures within the required period shall result in its certificate of recognition being revoked. Once the CARTV has deemed the noncompliance has been resolved, it shall inform the certifying body. Before doing so, the CARTV may however carry out an inspection visit to verify that corrective measures have been properly implemented, with the certifying body being charged for any expenses incurred
6.3 The approval granted to a certifying body shall also be revoked as soon as its compliance recognition becomes obsolete, either because the approval was formally waived by the holder or its period validity has come to an end, without the body having submitted a formal application for renewal, despite the fact that a notice was transmitted by the CARTV at least 30 days before its expiry.
6.4 The CARTV shall revoke the approval of any certifying body that has ceased operations or that is no longer accredited by a proper authority in the country where it is incorporated (in which its head office is located).
6.5 Whenever a certifier’s approval has been revoked, its name shall be removed from the CARTV’s list of approved organizations. Moreover, merchants registered with the CARTV as well as certifiers accredited by the CARTV shall all receive a notification to this effect.
6.6 Québec retailers, distributors and processors still having certified products in circulation on the Québec market must dispose of their products within 12 months after the date this notification was sent to registered merchants and to accredited certifiers. Beyond this date, any remaining stock may not be sold under the targeted designation.
6.7 The sale on Québec territory of all products certified by an organization beyond date on which approval was revoked is forbidden, unless the company producing them has obtained written authorization from the CARTV to market them. Any companies whose products were certified by an agency having had its approval revoked must agree to submit an application to a certifying body currently approved by the CARTV, within a period no longer than 6 months. In order to be allowed to continue to sell their certified products on the Québec market, the companies holding certificates and affected by this measure must, upon request, provide the CARTV with a letter of intent stating they are going to apply to a CARTV approved body for the certification of their products. Later on, the CARTV must receive a copy of the new certification documents, once issued by the accredited certifying body. The sale of these products in Québec shall no longer be authorized if the above documents are not delivered.
6.8 Any certifying body having had its approval revoked may once again submit an application to the CARTV for compliance recognition, twelve months following the date on which a revocation decision was made.
